Ward Engineering takes Kutenai Landing to court

Legal troubles for the Kutenai Landing developers have spread to Nelson where a local engineering firm has filed documents in small claims court for an alleged $12,000 in upaid bills.

According to court documents, Ward Engineering and Land Surveying Ltd. has provided consulting, engineering and legal survey services to Central Waterfront Enterprises for the Kutenai Landing project since 2007.

Central Waterfront Enterprises is the company developing the land for New Future Building Group.

An excerpt from Ward Engineering’s court documents read as follows:

Recently the owner has run into financial difficulties and has not been able to pay our most recent invoices which are highlighted below. There have been numerous promises to pay but nothing has materialized. The amount of the invoices is not in dispute.

Those invoices include:

  • Aug. 6, 2009            $3,311.44
  • Nov. 19, 2009          $7,770.21
  • Nov. 19, 2009            $250.00
  • Feb. 8, 2010                $651.00

Combined with associated fees, Ward Engineering is claiming a total $12,167.23.

As of publication, Central Waterfront Enterprises has not responded to the claim.

The Nelson Post was told representatives from Ward Engineering did not wish to comment on the case.

Calls to New Future’s head office in Kamloops were not answered. The receptionist’s extension was not attended and when connected to Mike Rink’s extension, a recorded voice said his mailbox would not accept any more messages.

Mike Rink was the developer’s spokesman for Kutenai Landing and handled media enquiries for New Future.

Other legal troubles

Ward Engineering’s claim is the latest in a string of troubles facing New Future. In Kamloops, the developer is facing 19 liens from contractors and a lawsuit for $114,000.

Deadlines looming

In addition, people that pre-bought units in the five-storey development can walk away at the end of September if New Future hasn’t secured funding by that time.

  1. Well, that’s interesting. Their former partners in crime. I’m getting the feeling now that KL is really done for and we will really know at the end of September I guess, when those who bought in can walk away.
    I think that our instincts, those in opposition to the project, were correct and council should have had a better idea of who they were dealing with. This has wasted a lot of City money I would guess.
